Vos J decision in Ibrahim v Barclays Bank Plc

Vos J has handed down his judgment in Ibrahim v Barclays Bank Plc [2011] EWHC 1897 (Ch). In this case, the claimant sought to be subrogated to the rights of the Secretary of State for Business, Innovation and Skills in relation to secured funding provided by Barclays, where a debt due to the Secretary of State under a counter-indemnity had been discharged. The case provides helpful guidance as to when the remedy of subrogation may be available to a claimant. Romie Tager QC and Hugh Jackson appeared for Mr Ibrahim.
