Declarations obtained in default and issue estoppel: Goldcrest Distribution v McCole [2016] EWHC 1571 Ch

Master Matthews has dismissed an application to vary a default judgment obtained on a defendant’s counterclaim at an inter partes hearing and upheld the declaratory relief granted as well as the consequent dismissal of the claimant’s claim on the basis of the same being required by the true extent of issue estoppel which arose by reason of the default judgment.
