Termination of Contractual Licence: West End Commercial Ltd v London Trocadero (2015) LLP [2017] EWHC 2175 (Ch)

Snowden J has handed down his judgment in West End Commercial Ltd v London Trocadero (2015) LLP [2017] EWHC 2175 (Ch). In this case, WECL occupied a unit in the Trocadero under the terms of a contractual licence. The licensor, LT, served a notice terminating the licence. WECL obtained an interim injunction restraining LT from interfering with its occupation of the unit. WECL asserted that LT was estopped from relying upon the notice of termination. Snowden J considered whether or not the injunction should continue and held that it ought not.

Nicholas Trompeter appeared for LT, who successfully resisted the continuation of the injunction.
