Gary Blaker KC and Paul de la Piquerie have successfully defended a nuisance, breach of covenant for quiet enjoyment and breach of contract claim.
The Claimant had brought a claim for damages in relation to complained-of popping noises at his flat in the West End. He had bought the flat for £2.6 million.
The case has received a great deal of coverage in the national press as the Claimant alleged that a sound similar to popping bubble wrap meant that he and his family were unable to sleep and reside at the flat.
After a 1 week trial in the TCC the judge Veronique Buehrlen KC dismissed all the Claimant’s claims.
