Partick-Hiley v Udal

Intelligent people can sometimes behave unreasonably where relations with their neighbours are concerned, and litigation results.

Mark Warwick KC was successful in such a case, where judgment was handed down last Friday (Partick-Hiley v Udal). Mark’s clients, the Claimants, paid £2m to buy a 5 bedroomed house, to which the sole access was along a passage through part of the Defendant’s house. The passage was accessed at one end by roller gates and a door. Although these features had been present for many years, Mr Udal did not like them. On the very day that the Claimants purchased their new home Mr Udal and an accomplice engaged in what the Judge called “an inappropriate and wrongful act of wanton destruction”.

In the course of the case, Mr Udal took various points. He lost on them all. As can be seen from the judgement here.
