Overriding Interests: Wishart v Credit & Mercantile Plc [2015] EWCA Civ 655

The Court of Appeal has handed down its judgment in Wishart v Credit & Mercantile Plc [2015] EWCA Civ 655. The case concerns the so-called ‘Brocklesby principle’ i.e. the rule of law which, when it applies, prevents an occupier of property from having a relevant right against the legal owner.
