Important decision in Fitzwilliam v Richall Holdings Services Ltd

Richard Clegg appeared for the successful Claimant in the recent High Court case of Fitzwilliam v Richall Holdings Services Ltd, where Mr Justice Newey held that the “statutory magic” of registration under the Land Registration Act 2002 vests only the legal title but not the beneficial interest. The case concerned the transfer of a property under a forged power of attorney. The case is likely to prove of considerable importance to secured lenders and real property practitioners.
