Guidance on the application of CPR r.32.12 to affidavits and the survival and application of the collateral undertaking

Sarah Walker successfully obtained permission for the Official Receiver to give an affidavit, and the documents attached to it, to the SFO for use in their prosecution of two directors charged with fraud in relation to Brazilian teak investment schemes.

In the judgment, the court gave guidance about the application of CPR r.32.12 to affidavits and the survival and application of the collateral undertaking.
