In August the Supreme Court handed down its judgment on three conjoined appeals arising out of the payment of commissions to car dealers by lenders which entered into finance agreements with persons buying cars from those dealers: Hopcraft v Close Bros Ltd [2025] UKSC 33.

In this article William McCormick KC considers the wider implications of the decisions for the recognition of fiduciary duties in a commercial context and for the use of the tort of bribery.
