HHJ Cooke (sitting as a Judge of the High Court, Chancery Division) has handed down his judgment in Stupples v Stupples & Co [2012] EWHC 1226 (Ch). The case addresses the difficult question of when a fiduciary might be stripped of his contractual entitlement to professional fees. In particular, is it necessary to show dishonesty on the part of the fiduciary? Nicholas Trompeter appeared for the Claimant.
