Edward Bartley Jones QC (sitting as a judge of the Chancery Division) has handed down his judgment in Kearns Brothers Ltd v Hova Developments Ltd [2012] EWHC 2968 (Ch). The case concerned a joint venture for the development of land in Maidenhead and in Oxted. The decision contains useful guidance as to the nature of the Pallant v Morgan type trust.
