The Court of Appeal has handed down its judgment in Ezekiel v Kohali [2009] EWCA Civ 35 (30th January 2009).
Gary Blaker appeared on behalf of the successful first respondent.
Applying the principle in McGrory v Alderdale Estate Company [1918] AC 503, the Court of Appeal upheld the trial judge’s finding that prospective purchasers of land had entered into the sale agreement with actual knowledge that the vendors did not have good title to all the land which was to be sold.
