Andrew Smith J has handed down his judgment in Dar Al Arkan Real Estate Co v Al Refai [2015] EWHC 1793 (Comm). The case raised an important point of principle: viz. whether orders previously made in the case that a defendant pay the costs of a claimant should be overridden upon the discontinuance of the claim by the claimant.
