Barnaby Hope was successful in the Court of Appeal in the case of Azuonye v Kent [2019] EWCA Civ 1289, which was a second appeal concerning whether a liability on a discharged to make payments under an income payments order was discharged by a subsequent bankruptcy. The Court held that such payments constituted provable debts and as such the trustee’s only remedy was to prove in the subsequent bankruptcy; there was no entitlement to seek further payment from the bankrupt directly.
