Ramsey J has handed down his second judgment in the ongoing Arqiva litigation – [2011] EWHC 2016 (TCC). This decision involves, inter alia, the construction of Section 30 of the Wireless Telegraphy Act 2006 against the background of the various European Directives which it implemented. This is the first reported decision on the Wireless Telegraphy Act 2006 and Ofcom’s ability to vary spectrum licenses thereunder. Juliette Levy appeared for the successful Claimants.
