Maxwell Myers recently acted for the successful Claimants in an eight-day trial before His Honour Judge Lochrane of a claim for a substantial contractual debt arising out of a complex household renovation and construction contract. The trial involved issues as to the correct application of the common law penalty doctrine following the judgment of the Supreme Court in Cavendish Square Holding BV v Talal El Makdessi [2015] UKSC 67 and the evidential burden of proving the existence of oral variations to a contract in writing.
