Untangling the web of lies: Islam v Islam [2024] EWHC 1082 (Ch) and family portfolio disputes

The very recent decision (May 2024) of Mr Justice Rajah provides a detailed review of the topics of sham trusts (§§136-147), forgeries and the requirements of handwriting experts (§§100-117), undue influence (§§162-169), and illegality (§§144-147) – all in the context of a factually-complex family property dispute in which much of the evidence was disbelieved and found to contain self-serving lies.

This talk will explore and discuss aspects of the law and practice commonly engaged in dealing with difficult family property ownership disputes, and provide invaluable lessons from the front line.
