Successful relief from sanctions application: Kazakhstan Kagazy Plc & Ors v Zhunus & Ors [2020] EWHC 2431 (Comm) (10 September 2020)

William McCormick QC successfully represented the sixth and seventh Defendants in Kazakhstan Kagazy Plc & Ors v Zhunus & Ors [2020] EWHC 2431 (Comm) (10 September 2020) leading Joe-han Ho and Rebecca Drake from 39 Essex Chambers, instructed by Robert Dougans of Prieskel & Co.

Henshaw J dismissed the Claimants’ attempt to obtain final charging orders against two London Properties worth £38m. He concluded that the Respondents were not in breach of the relevant ‘unless’ orders. He also stated ‘In case I am wrong in that conclusion, I have considered whether relief from sanctions should be granted in relation to the limited respects in which (in my view) there was any possible non-compliance, and concluded that it should.’

This matter will now proceed to trial.
