Successful Opposition to Claim for Judicial Review: R (o.a.o. Flannigan) v The Director of Legal Aid Casework

HHJ Bird (sitting as a Judge of the High Court) has handed down his judgment in R(o.a.o. Flannigan) v The Director of Legal Aid Casework. Mr Flannigan had brought a claim for judicial review of the decision to make (and then amend) a capital contribution order under The Criminal Defence Service (Contribution Orders) Regulations 2009. The case raised issues of statutory construction and the applicability of Article 1 of the First Protocol of the European Convention of Human Rights.
