Ross v Phillips & Ors [2026] EWHC 2227 (Ch): taking an account where a trustee has failed to provide proper disclosure – Article by Barnaby Hope

In Ross v Phillips & Ors [2026] EWHC 2227 (Ch), Master Teverson (sitting in retirement) considered the approach to the taking of an account following a trustee’s failure to comply with orders requiring him to provide a verified account of rental income and expenditure.

The proceedings concerned 3 investment properties in Chatham. In an earlier judgment, HHJ Johns KC had held that a 2015 declaration of trust purporting to transfer their beneficial ownership from HRP Complete Solutions LLP (“the LLP”) was invalid. The properties therefore remained beneficially owned by the LLP. An account was subsequently directed of the income and expenditure relating to the properties from October 2015 onwards.

Barnaby Hope, instructed by Matt Champ of Colman Coyle Limited, appeared for the claimant.
