John Kahlbetzer v David Aldridge
Nicholas Towers represented the defendant to a restitutionary claim for US$1 million.
An unknown third party tricked the claimant into transferring the sum into the defendant’s foreign exchange account, which he disbursed to several overseas companies on the email instructions of a person he believed to be his long-term girlfriend, but who was a “romance scammer”. The defendant retained $80,000 himself.
The claimant sought the return of the full US$1m on the grounds of unjust enrichment, knowing receipt, dishonest assistance and breach of trust.
The case settled on day two of the four-day trial.
