Abuse of the Process of the Court: Barnett-Waddington Trustees (1980) Ltd v The Royal Bank of Scotland Plc [2017] EWHC 834 (Ch)

Mark Warwick QC & Justina Stewart achieve a significant success for their clients against the Royal Bank of Scotland. Mr Justice Mann has ruled, that that the Bank’s claim to levy a charge of £5million should their clients redeem their loan early, was an abuse of the process of the Court.
