Programme

In this session, we will explore some of the key challenges in multi-jurisdictional litigation including:

– Jurisdictional challenges.
– The procedure for service of documents from overseas claims in this jurisdiction.
– Disclosure and the use documents and witness statements out of the jurisdiction.
– Anti-suit (and anti-anti-suit) injunctions.
– Enforcement – litigating and obtaining judgment in England and enforcing elsewhere.

Nicholas Trompeter KC
Call: 2006/2021

Nick is a commercial practitioner who acts in a wide range of business disputes, both in litigation and arbitration. He is recommended as a Silk across Chambers & Partners, Chambers Global, the Legal 500 and Who’s Who Legal in four practice areas: (1) Commercial Litigation; (2) Commercial Chancery Litigation; (3) Real Estate / Property Litigation; and (4) Professional Negligence. Nick is a Fellow of the Chartered Institute of Arbitrators. He is currently appointed to the DIAC (Dubai) and CAMC (Cyprus) Arbitrator Lists.

Before taking Silk, Nick was awarded ‘Real Estate’ junior barrister of the year in both The Legal 500 Awards and the Chambers UK Bar Awards 2019 (the first time a barrister has won both awards in the same year). He is the co-author of Warwick & Trompeter, Break Clauses, (3rd Edition, Hart Publishing, 2022) and was previously on the Attorney-General’s C and B Panels of Counsel.

Simon McLoughlin

Simon’s practice covers all areas of Commercial Chancery litigation and arbitration.

Simon is recommended in both the leading legal directories. Chambers & Partners (2025) notes that “Simon is an excellent barrister who is a go-to for complex, knotty legal issues…[and] charming to deal with…[He] is impressive on his feet… is very clever and has a deep understanding of the law. He also has a great academic intellect, very good client care skills and is exceptional at cross-examination.” The Legal 500 (2025) describes Simon as “…very easy to deal with, his written work is first-rate, and he is a good advocate. He is a good persuader…exceptionally bright and [a] fierce advocate.”

Simon regularly appears as an advocate in the High Court (Business & Property Courts) and in arbitration. He has particular expertise in disputes involving the consideration of valuation, accounting and other technical expert evidence.

Sarah Walker
Call: 2013

Sarah’s practice covers all areas of Commercial Chancery litigation with a particular focus on commercial disputes, company and partnership matters, insolvency, real property and landlord and tenant.

She is an experienced trial advocate and regularly appears as sole counsel in the Chancery Division, the Insolvency and Companies Court, and the County Court. In addition, Sarah has considerable experience operating as part of a team on larger and more complex litigation.

Sarah is appointed to the Attorney General’s C Panel of Junior Counsel to the Crown and is frequently instructed to advise and represent government departments and agencies, including HMRC, the Insolvency Service, the Official Receiver and the Secretary of State for Business, Energy and Industrial Strategy.
