Romie Tager QC represented the defendant in Dukeminster Limited v West End Investments (Cowell Group) Limited. The decision is of considerable importance to landlord and tenant practitioners due to the way it deals with the following:

  • The apparently defective s. 25 notice and the Mannai principle
  • The way the judge totally rejected one valuer’s evidence and based the rent entirely on the landlord’s expert’s evidence, and
  • The way the judge dealt with the length of term-ordering 10 years when the tenant was only seeking 5.
