Court of Appeal delivers judgment in Milebush Properties Ltd v Tameside Metropolitan Borough Council

The dispute concerned the enforcement of rights arising under a s.106 agreement and whether enforcement by a non-party beneficiary should be by way of proceedings for declaratory relief. The decision gives guidance as to the scope of declaratory relief, and the circumstances in which such relief may be granted. Mark Warwick appeared for the Appellant.
