The Court of Appeal has handed down its decision in Quest Advisors Ltd v McFeely [2011] EWCA Civ 1517, part of a long-running saga relating to the sale and leaseback of a development site. Here, the Court had to consider the lawfulness of two decisions made in relation to the construction of a Court order, finding that there had not been a repudiation of contract, and requiring one party to pay a lump sum in respect of money owed thereunder. Mark Warwick appeared for the successful appellant.
