Court of Appeal decision in Duncan Cavenagh v William Evans

The Court of Appeal has handed down its decision in Cavenagh v William Evans [2012] EWCA Civ 697 in which it found that an employee, discovered after dismissal to have been guilty of gross misconduct, was still entitled to a substantial payment in lieu of notice. The employer, who was represented by Stuart Cakebread, is seeking to appeal to the Supreme Court.
