The Court of Appeal has handed down its decision in Bank of Scotland v Joseph [2014] EWCA Civ 28. This is the first time that the Court of Appeal has had to consider the use of unilateral notices registered pursuant to the Land Registration Act 2002. In particular: in what circumstances does a notice registered in respect of one property interest give priority to a different interest? Mark Warwick QC appeared for the appellant.
