Bootle v GHL Property Management and Development Ltd & anr [2025] EWHC 317 (Ch)

Gary Blaker KC appeared in this trespass and boundary dispute.  It is unusual because the case concerned the cutting down of a significant number of trees, bushes and vegetation along a 120 metre boundary running between two properties in Chorley, Lancashire. 

Gary’s client, the Claimant owns a residential property and it is situated next to a site being developed as a retail warehouse site. After a trial in the High Court in Manchester, the court determined the position of the boundary between the two properties. The scale and extent of the trespass was significant and Gary’s client has been awarded damages for trespass and an injunction to prevent further trespass from occurring.  Damages for the trespass will be assessed at a second trial.
