Tipping the scales in favour of tenants
The Landlord and Tenant Act 1988 tipped the scales in favour of tenants who sought their landlord’s consent when assigning a lease or underletting a property. Recent judicial developments suggest the balance may now be too far in the tenant’s favour. Aspects of the Act deserve examination to highlight an issue that remains unresolved and may represent a trap for the unwary landlord.
